ELICEC Terms of Service

1. General

These Terms of Service apply to the use of the ELICEC website and online store and to all orders placed through elicec.com.

The terms “we”, “us” and “our” refer to ELICEC. Our online store is powered by Shopify.

By using our website and/or placing an order, you agree to these Terms of Service and the other policies applicable to our website.

Your statutory rights as a consumer remain unaffected at all times.

2. Our artworks

ELICEC offers artworks in various sizes and finishes.

We take great care to present our artworks as accurately as possible. Please note that colours, contrast, brightness and details displayed on a screen may differ slightly from the finished physical product. These differences may result from factors such as screen settings and the material or finish selected.

Interior images showing our artworks in a room are intended to illustrate their appearance and how they can be displayed. The proportions or dimensions shown in these images should not be used to determine exact measurements. The dimensions stated in the product description take precedence.

3. Orders and made-to-order production

When placing an order, you select your preferred artwork, size and finish.

Every artwork is produced specifically to order in your chosen size and finish. Please check carefully that you have selected the correct size and finish before completing your order.

After placing an order, you will receive an order confirmation by email. Please check this confirmation and contact us as soon as possible if you notice an error.

As production may begin after your order is placed, changes or cancellations cannot always be processed once production has started. This does not limit your statutory rights as a consumer.

ELICEC reserves the right to refuse or cancel an order where there is a justified reason, such as an obvious pricing or product error, payment issues, fraud or an unexpected inability to supply a product. If we cancel an order that has already been paid for, the relevant amount will be refunded.

4. Prices and payment

The consumer prices displayed on elicec.com include VAT, unless expressly stated otherwise.

Any shipping costs are clearly displayed before you complete your order.

The price applicable at the time the order is placed applies to that order.

Payment must be made using one of the payment methods offered at checkout. An order can only be processed and/or put into production once payment has been successfully processed.

5. Shipping and delivery

Our artworks are made to order. Delivery times therefore include both production and shipping.

Current information about production, shipping and estimated delivery times is provided in our Shipping Policy and, where applicable, on the product page.

Delivery times are estimates. We make every effort to have orders produced and delivered within the stated timeframe.

If a delivery is delayed, we will inform the customer where reasonably possible.

For deliveries to consumers, the risk of damage or loss remains with ELICEC until the order has been received by the customer or a third party designated by the customer, other than the carrier, subject to statutory exceptions.

6. Damage, manufacturing defects and non-conformity

We want every artwork to arrive in good condition.

If you receive a damaged artwork or an incorrect product, or discover a manufacturing defect, please contact us as soon as possible at info@elicec.com.

Where possible, please include photographs of the artwork, the damage and the packaging. This helps us assess the issue promptly and, where necessary, resolve it with the manufacturer or carrier.

If a product does not meet the standards you could reasonably expect under the contract, your statutory warranty rights apply.

7. Returns, cancellations and the right of withdrawal

Returns, cancellations and any refunds are governed by our separate Returns and Refund Policy.

Nothing in these Terms of Service limits your statutory rights as a consumer.

8. Accounts and customer information

When you create an account or provide information for an order, you are responsible for ensuring that the information is accurate, current and complete.

You are responsible for keeping any account login details confidential.

Personal data is processed in accordance with our Privacy Policy.

9. Intellectual property

The content of elicec.com, including artworks, images, photography, text, graphic design, logos, trade names and other content, belongs to ELICEC and/or the respective rights holders, to the extent that such content is protected by intellectual property rights.

Without prior written permission, you may not copy, reproduce, distribute, modify, sell or otherwise exploit this content for commercial purposes, unless permitted by law.

Purchasing a physical artwork does not transfer any copyright or other intellectual property rights in the depicted work.

10. Use of the website

You may use our website only for lawful purposes.

You must not use the website in any way that could disrupt its operation, security or availability, or infringe the rights of ELICEC or third parties.

We reserve the right to restrict access to our website or certain features in cases of misuse, fraud or other unlawful use.

11. Third-party services and links

We use external service providers for certain parts of our online store, including Shopify and payment and shipping partners.

Where our website contains links to third-party websites, we are not responsible for the content or services provided by those websites. Their use may be subject to the terms and privacy policies of the relevant third party.

12. Shopify

Our online store is powered by Shopify.

However, orders placed through our online store are placed directly with ELICEC. ELICEC is responsible for selling the products offered and for fulfilling the contract with the customer.

13. Liability

ELICEC is responsible for properly fulfilling the contracts entered into with us through our online store.

To the extent permitted by law, we are not liable for damage resulting from circumstances reasonably beyond our control.

Nothing in these terms is intended to exclude or limit liability where such exclusion or limitation is not permitted under applicable law.

Consumers’ statutory rights remain unaffected.

14. Website errors

Although we maintain our website with care, obvious typographical, pricing, technical or other errors may occasionally occur.

We reserve the right to correct such errors. If an error affects an order that has already been placed, we will contact you where necessary to reach an appropriate solution.

15. Force majeure

ELICEC is not responsible for delays or failures to fulfil its obligations caused by circumstances reasonably beyond our control, such as major disruptions affecting carriers, natural disasters, war, government measures, strikes, system failures or other events of force majeure.

Your statutory rights remain unaffected.

16. Changes

We may update these Terms of Service from time to time, for example when our services or applicable laws and regulations change.

An order is governed by the terms applicable at the time the contract was concluded, unless a change also applies to existing contracts by law.

The latest version of these terms is available on elicec.com.

17. Governing law

Contracts with ELICEC are governed by Dutch law.

If you are a consumer residing in another country, this choice of law does not affect any mandatory consumer protection to which you are entitled under the laws of your country of residence.

Disputes may be submitted to the court with jurisdiction under applicable law.
